Terms of Use
By using Vantage, you agree to these terms. They explain how the service works, what we promise, what we don't, and what behaviour is expected from you. Read them carefully.
About these terms
These Terms of Use form a binding agreement between you and the operator of Vantage (vantageplanner.app). They govern your use of the website, the web application at /app, any mobile applications we publish, and all related services.
If you do not agree to these terms, do not use Vantage. If you continue to use Vantage, you accept these terms.
The service
Vantage is a shoot-planning tool for landscape photographers. It uses publicly available weather data to provide forecasts and condition assessments for locations you specify. The service includes:
- Forecast checks for sunrise, sunset, golden hour, and other photographic moments
- Condition presets (fog, dappled light, dramatic skies, and similar)
- Saved location storage with optional push notifications
- Custom condition presets you create yourself
Accounts
You may use Vantage without an account, but some features (saved locations, push notifications, sync across devices) require one. By creating an account you confirm:
- You are at least 16 years old
- The information you provide is accurate
- You are responsible for keeping your password secure
- You are responsible for all activity under your account
You may delete your account at any time by emailing support@vantageplanner.app.
Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from Vantage
- Use automated tools to scrape, crawl, or excessively query the service
- Attempt to bypass authentication, rate limits, or other security measures
- Use Vantage to harass, threaten, or harm others
- Resell, sublicense, or redistribute the service without explicit written permission
- Use the service for any unlawful purpose
- Probe, scan, or test the vulnerability of any system or network connected to Vantage
We reserve the right to suspend or terminate accounts that violate these terms.
Intellectual property
The Vantage name, logo, design, code, and editorial content are owned by the operator of Vantage and protected by copyright, trademark, and other applicable laws. You receive a limited, non-exclusive, non-transferable license to use the service for personal, non-commercial purposes. All rights not expressly granted are reserved.
Weather data is sourced from third parties under their respective licenses. Map and routing data are provided by Google Maps Platform under their terms.
User content
If you create custom presets, save locations, or submit accuracy ratings, you retain ownership of that content. By submitting it to Vantage, you grant us a worldwide, royalty-free license to store, process, and display that content as needed to operate the service. We do not publish or share your content publicly without your explicit consent.
Beta status
Vantage is currently in beta. Features may change without notice. Service may be temporarily unavailable. Bugs may exist. By using the beta, you accept these limitations and agree to provide reasonable feedback when issues occur.
Subscriptions and payments
How subscriptions work
Vantage is offered as a paid subscription with two plans: monthly and annual. Pricing is shown in your local currency at checkout (handled by our payment processor, Stripe). Payment is taken automatically at the start of each billing period (monthly or yearly) until you cancel.
Free trial
New subscribers may be offered a 7-day free trial. You do not need to provide payment details to start the trial. At the end of the 7-day period, your access to the service ends unless you have subscribed to a paid plan. The trial is offered once per person. If you attempt to use multiple email addresses, deleted-then-recreated accounts, or any other method to obtain repeat trials, the trial may not be available to you.
Pricing and changes
Current pricing is displayed in the app at the point of subscription. We may change prices with at least 30 days' notice via email or in-app notification. Price changes apply to your next billing period — you will never be charged a different amount mid-cycle.
Cancellation
You may cancel your subscription at any time through the "Manage subscription" option in your account, which opens a secure portal hosted by Stripe. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not refund partial periods (the unused remainder of a monthly or annual subscription), except where required by law.
Refunds
UK residents have statutory rights to cancel subscriptions during the first 14 days under the Consumer Contracts Regulations. By starting to use Vantage immediately after subscribing, you accept that you may lose this right of cancellation. Outside of statutory rights, refunds are considered on a case-by-case basis at our discretion. To request a refund, email support@vantageplanner.app.
Failed payments
If a renewal payment fails, Stripe will automatically retry over several weeks. During this period, your account may show "Payment issue" status. If all retries fail, your subscription will be canceled and access will be revoked. You can update your payment method via the "Manage subscription" portal at any time.
Beta testers
A small number of invited beta testers have been granted lifetime free access in recognition of their feedback and contributions. This grant is conditional on continued reasonable use of the service. Sharing your access code with others, breach of these terms, or other misconduct may result in revocation of the lifetime free grant, after which the standard subscription terms apply.
Taxes
Prices shown are inclusive of VAT or other applicable taxes for your jurisdiction where required. Stripe handles tax calculation and invoicing on our behalf.
Payment processor
All payment processing is handled by Stripe (Stripe Payments Europe Limited and Stripe, Inc.). We do not store or process credit card or banking information on our servers. By subscribing, you agree to Stripe's consumer terms.
Disclaimer of warranties
Vantage is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the service will be uninterrupted, timely, secure, or error-free
- Warranties that forecasts will be accurate
- Warranties that the service will meet your specific requirements
You use Vantage at your own risk.
Limitation of liability
To the maximum extent permitted by law, the operator of Vantage shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes but is not limited to:
- Missed photographic opportunities
- Wasted travel or accommodation costs
- Lost data, lost profits, or business interruption
- Personal injury or property damage resulting from travel undertaken in reliance on Vantage forecasts
Our total liability for any claim arising from your use of Vantage is limited to the amount you have paid us in the 12 months preceding the claim, or £50, whichever is greater.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.
Indemnification
You agree to indemnify and hold harmless the operator of Vantage from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these terms, your misuse of the service, or your violation of any third party's rights.
Termination
You may stop using Vantage at any time. We may suspend or terminate your access to the service if:
- You violate these terms
- We are required to do so by law
- We discontinue the service
On termination, your right to use the service ends immediately. Provisions relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.
Changes to these terms
We may update these terms occasionally. The "Last updated" date at the top reflects the most recent change. Material changes will be communicated via email if you have an account. Continued use of Vantage after changes constitutes acceptance of the updated terms.
Governing law and jurisdiction
These terms are governed by the laws of England and Wales. Any dispute arising from your use of Vantage shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection law in your jurisdiction provides otherwise.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions remain in full effect. The unenforceable provision shall be replaced with an enforceable provision that achieves the intent of the original as closely as possible.
App Store distribution (iOS)
The following terms apply if you obtained Vantage from the Apple App Store. They are required by Apple as a condition of distributing the iOS app:
- Parties: These terms are between you and the operator of Vantage. Apple Inc. is not a party. The operator of Vantage, not Apple, is solely responsible for the iOS app and its content.
- Scope of licence: The licence granted to you is limited to a non-transferable licence to use the iOS app on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms.
- Maintenance and support: The operator of Vantage is solely responsible for any maintenance and support for the iOS app. Apple has no obligation to furnish any maintenance or support.
- Warranty: The operator of Vantage is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the iOS app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the iOS app.
- Product claims: The operator of Vantage, not Apple, is responsible for addressing any claims by you or any third party relating to the iOS app, including but not limited to product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- Intellectual property: In the event of a third-party claim that the iOS app or your use of it infringes that party's intellectual property rights, the operator of Vantage, not Apple, is solely responsible for the investigation, defence, settlement and discharge of such claim.
- Third-party beneficiary: You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these terms, and that upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
- Export and compliance: You represent that you are not located in any country that is subject to a U.S. Government embargo and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Entire agreement
These terms, together with our Privacy Policy, constitute the entire agreement between you and Vantage regarding your use of the service, and supersede any prior agreements.
